Primera aparición pública de la Comisión de Defensa a la Competencia.

El pasado martes 29 de noviembre, en ocasión del cierre del Diplomado en Derecho de la Competencia ofrecido por la Universidad Iberoamericana y organizado por las Licenciadas Biviana Rivero, Laura Castellanos y Yomaira Martinó, 4 de los 5 miembros del Consejo Directivo de la Comisión de Defensa a la Competencia, hicieron su primera comparecencia pública, donde ofrecieron importantes informaciones sobre la institución que han de dirigir, actualmente en proceso de estructuración.

Los comisionados presentes, fueron los Licenciados Luis Reyes, Magdalena Gil de Jarp, Antonio Rodríguez Mansfield y Leyda Reyes. La Lic. Esther Aristy, presentó sus excusas.

Dichos funcionarios explicaron que actualmente se encuentran en el curso de la de discusión de la estructura orgánica y flujos de procesos para el funcionamiento de la institución. En ese orden, deciden el número de divisiones departamentales y personal técnico y administrativo a requerir, para cumplir con los mandatos esenciales exigidos por la Ley No. 42-08, incluyendo a la Dirección Ejecutiva, la cual aún se encuentra vacante.

Asimismo, informaron que se han elaborado los términos de referencia de los proyectos de consultoría internacional a requerir de algunas agencias internacionales, destinados a asistirles en la preparación de los manuales de manejo de casos, elaboración de los primeros estudios de diagnóstico de mercados prioritarios y otras tareas/producto. Junto a esas tareas, los funcionarios también llevan a cabo las gestiones administrativas de rigor, para la formal creación del nuevo organismo regulador, como parte del tren administrativo.

Estiman que no será hasta el segundo semestre de 2012, que la institución esté lista para recibir casos o iniciar investigaciones de oficio. Sin embargo, es dable que durante ese primer semestre se inicie la discusión en consulta pública de los procedimientos y reglamentos que regirán el debido proceso administrativo de la entidad.

Finalmente, anunciaron que la República Dominicana, será el país anfitrión de Foro Latinoamericano de Competencia, OCDE-BID, a ser celebrado en esta ciudad, en Septiembre de 2012.

First public appearance of the Competition Defense Commission.

On Tuesday November 29, during the closing of the Certificate Course in Competition Law offered by UNIBE (Universidad Iberoamericana) and organized by lawyers Biviana Rivero, Laura Castellanos and Yomaira Martinó, four of the five members of the Board of the Competition Defense Commission made their first public appearance. During said appearance they provided important information about the institution they are to direct, currently undergoing a restructuring process.

The officials present at the event were Commissioners Luis Reyes, Magdalena Jarp Gil, Antonio Rodriguez Mansfield and Leyda Reyes. Commissioner Esther Aristy, was not able to attend, and formally presented her excuses.

They explained that they are currently in the midst of the discussion regarding the organizational structure and process flows for the operation of the institution. Moreover, they are deciding the number of departments and/or divisions and technical and administrative staff required to meet the essential terms required by Law No. 42-08, including the Executive Office, which is still vacant.

They also reported that they have developed the terms of reference for the international consulting projects that will be required from some international agencies, in order to assist them in the preparation of case management manuals, development of the first diagnostic market studies of priority markets and other tasks/products. Along with these tasks, the officials are also conducting the rigorous administrative procedures for the formal creation of the new regulatory body, as part of the administration works.

Nevertheless, they believe that the institution will not be ready to receive cases or initiate investigations until the second half of 2012. However, it is possible that during the first semester of the coming year they might open to public discussion the consultation process of the procedures and regulations that will govern the administrative due process of the entity.

Finally, they announced that the Dominican Republic will host the Latin American Competition Forum, OECD-IDB, to be held in this city, in September 2012.
